I. General Provisions

The Online Store operating at https://puremanufacture.eu/shop/ is managed by: PURE MANUFACTURE BARNABA SZCZEPAŃSKI, JAROSŁAW NAUMCZYK SPÓŁKA CYWILNA (s.c.) Registered office: ul. These Regulations define the rules for using the Store, the principles for concluding Sales Agreements for Goods, and the procedures for withdrawal from the Agreement and complaint handling.

Definitions:

  • Customer: Any entity (natural person, legal person, organizational unit) making purchases in the Store.
  • Consumer: A Customer who is a natural person making a purchase not directly related to their business or professional activity.
  • Goods (Product): A movable item offered for sale in the Store (sports equipment).
  • Order: The Customer’s declaration of intent aimed directly at concluding a Sales Agreement.

To use the Store, the following are required: a device with Internet access, a web browser, and an active e-mail account. Product prices in the Store are gross prices (including VAT). The settlement currency and basis of the transaction is the Polish Złoty (PLN). If the buyer chooses to settle in Euro during the order, the settlement will be made in the selected currency. The Seller reserves the right to withdraw certain Goods from sale, change their prices, and introduce or modify promotional offers depending on market conditions.

II. Registration and Security Rules

1. Creating a Customer Account in the Store is voluntary and free of charge. Customers may also place an Order without registration.
2. The Customer is responsible for maintaining the confidentiality of their Account login and password.
3. Customers are obliged to refrain from providing content to or through the Store that:

  • Causes disruption or overload of the Store or other entities involved in providing electronic services.
  • Is unlawful, infringes on third-party rights, is vulgar, defamatory, or violates principles of social coexistence.

4. In the event of a breach of law or these Regulations, the Seller has the right to terminate the agreement for the provision of electronic services (e.g., by deleting the Customer Account).

III. Placing and Executing Orders

1. To make a purchase, the Customer places an Order for Goods as specified in the Regulations (adding to the cart and filling out the form).
2. After placing the Order, the Customer receives an e-mail confirming its acceptance for processing, which constitutes the conclusion of the Sales Agreement.
3. Payments: The Customer can choose from the following payment methods:

  • Traditional bank transfer:

  • Electronic payments and card payments via the Stripe operator.

4. In the case of advance payment, the Customer is obliged to make the payment within 7 calendar days from the date of the agreement. Lack of payment may result in the cancellation of the Order.
5. Order fulfillment times:

  • Personalized equipment (made-to-order): The lead time for personalized equipment (manufactured according to individual Customer specifications) is up to 4 weeks from the moment the payment is credited to the Seller’s account.
  • Ready-made equipment: The lead time for equipment ready for shipment within Poland is up to 4 business days from the moment the payment is credited to the Seller’s account.
  • International orders: The lead time for orders outside Poland is determined individually for each order and depends on the destination country. The Customer will be informed of the estimated delivery date via e-mail.

IV. Shipping and Delivery Costs

1. Purchased Goods over 500 PLN are shipped within Poland free of charge. Shipping outside the country is possible only after individual arrangements.
2. Delivery of Goods is carried out via courier companies: DPD, UPS, DHL, InPost (courier), or Poczta Polska.
3. The delivery cost covers 1 package weighing no more than 30 kg. In the case of multiple packages or exceeding the weight limit, the delivery cost increases accordingly to the price list available on the Store’s website.

V. Right of Withdrawal from the Agreement

1. A Customer who is a Consumer has the right to withdraw from the Sales Agreement within 14 calendar days without giving any reason.
2. The withdrawal period expires after 14 days from the day the Consumer took possession of the item.
3. To exercise the right of withdrawal, the Consumer must inform the Seller (via phone, e-mail: sklep@puremanufacture.eu, or in writing) of their decision by an unequivocal statement.
4. The Customer bears the direct costs of returning the Goods.
5. The Seller shall refund the payment to the Consumer immediately, but no later than 14 days after receiving the statement. The Seller may withhold the refund until the Goods are received back.
6. Exceptions: The right of withdrawal does not apply to Sales Agreements where the subject of the service is a non-prefabricated item, manufactured according to the Consumer’s specifications or serving to satisfy their individual needs (Personalized Equipment).

VI. Complaints and Statutory Liability

1. The Seller is obliged to deliver Goods without defects and is liable for the non-conformity of the goods with the agreement as provided by law.
2. Complaints can be submitted via the Store’s contact details or in writing to the Seller’s registered address.
3. The Seller shall respond to the complaint immediately, no later than within 14 calendar days of its receipt.
4. The Customer does not have the right to file a complaint regarding goods delivered free of charge as bonuses/gifts.

VII. PURE MANUFACTURE PRODUCT WARRANTY TERMS

1. General Provisions:

  • The Guarantor is PURE MANUFACTURE BARNABA SZCZEPAŃSKI, JAROSŁAW NAUMCZYK S.C. based in Myślenice (hereinafter: Guarantor).
  • The warranty is valid in Poland and countries to which the Guarantor ships directly.
  • The warranty is granted for a period of 24 months from the date the goods are delivered to the Buyer.

2. Warranty Scope and Personalized Equipment:

  • The warranty covers physical defects of the product arising from causes inherent in the product (material, structural, or manufacturing defects).
  • Personalized Equipment: For goods manufactured to the Customer’s individual specifications, the Guarantor ensures the product’s compliance with the approved design/dimensions with a manufacturing tolerance of +/- 3 mm (unless otherwise agreed).
  • The warranty only covers structural elements. Consumable elements (base/slider, edges, finishing coating) are covered by the warranty only if defects are found at the time of receipt.

3. Warranty Exclusions:

  • Damage resulting from use contrary to purpose, instructions, or exceeding maximum loads.
  • Personalization specifics: Complaints regarding minor aesthetic differences resulting from handcrafted (hand-made) methods are not accepted, provided they do not affect safety and functionality.
  • Incorrect Customer data: The warranty does not cover defects resulting from incorrect measurements or design assumptions provided by the Customer.
  • Normal wear and tear (e.g., natural paint wear, excessive servicing of base and edges).

4. Complaint Procedure:

  • The Buyer must stop using the defective product and report the defect to: sklep@puremanufacture.eu.
  • The Guarantor will respond within 14 calendar days.

5. Buyer’s Obligations: The Buyer must check the shipment upon receipt. In case of transport damage, a damage report signed with the courier is required.

VIII. Personal Data Protection (GDPR)

1. The Administrator of the Customers’ personal data is the Seller.
2. Personal data is processed for the performance of Sales Agreements, fulfillment of legal obligations, and the Seller’s legitimate interests (e.g., pursuing claims).
3. Detailed rules are specified in the Privacy Policy available on the Store’s website.

IX. Final Provisions

1. In matters not regulated by these Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
2. Any disputes shall be resolved by the competent courts in accordance with Polish law.
3. The Consumer may use out-of-court complaint handling methods (e.g., the ODR platform).
4. These Regulations enter into force on December 6, 2025
